PICA Assault Weapons Ban Litigation 5th Update

An (expected) loss today, but….

Yesterday our 3-Judge Panel in the 7th Circuit Court of Appeals (CA7) issued a stay on Judge McGlynn’s
overturning of the Illinois “Assault Weapons" Ban (PICA). This means that we will not be able to buy, sell,
transfer, or manufacture banned items when Judge McGlynn’s 30-day stay of his decision expires on
Monday.

There is some good news here, though:

We now know the composition of our 3-Judge Panel for the appeal:

  • Easterbrook (bad)
  • Brennan (excellent, wrote a strong dissent last time)
  • Amy St. Eve (who is much, much better for us than the Judge she replaces, Judge Wood)

We will update this blog post upon reading the order and reviewing Judge St. Eve’s participation in the Viramontes case (Cook County AWB).
